End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you ("you") and the independent developer of Open3D Viewer ("the Developer", "we", "us") for the Open3D Viewer mobile application, including all of its software, bundled assets, and updates ("the Application"). By installing or using the Application, you accept this EULA.

Note for App Store users. This EULA is between you and the Developer only — not Apple, Google, or any app store. The Developer, not the app store, is solely responsible for the Application and its content.

1. Licence grant

The Developer grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the Application for your personal, non- commercial purposes on a mobile device that you own or control, in accordance with this EULA and with the Usage Rules of the app store from which you obtained it. On Apple platforms, this licence permits use on any Apple-branded products you own or control, as permitted by the App Store Usage Rules, and any associated use by family members on devices you enable via Family Sharing where applicable.

2. Ownership

The Application is licensed, not sold. The Developer and its licensors retain all right, title, and interest in and to the Application, including all intellectual property rights in its software, design, branding, logo, and original assets. This EULA gives you no rights to those except the limited licence above. Third-party open-source components are licensed under their own terms — see our Open-Source Licenses page.

Except to the limited extent that applicable law expressly permits despite this restriction, you must not, and must not permit anyone else to:

The Application processes 3D files and other content that you supply, entirely on your device. You keep all rights to your content. You are responsible for having the legal right to use any file you open, convert, or export with the Application.

5. Updates

The Developer may make updates, bug fixes, or new versions of the Application available. This EULA governs any such updates unless they are accompanied by a separate licence, in which case that licence governs.

6. Maintenance and support

The Developer is solely responsible for providing any maintenance and support for the Application, to the extent such maintenance and support is provided at all. Apple, Google, and the app stores have no obligation whatsoever to furnish any maintenance or support services for the Application. For support, contact konatalarajesh1@gmail.com.

7. Warranty disclaimer

To the maximum extent permitted by applicable law, the Application is provided "as is" and "as available", without warranty of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. See our Disclaimer for important detail on the accuracy of measurement and print-readiness features. In the event of any failure of the Application to conform to any applicable warranty that cannot be disclaimed, and where the Application was obtained through Apple's App Store, you may notify Apple and Apple will refund the purchase price (if any) of the Application to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.

8. Limitation of liability

To the maximum extent permitted by law, the Developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, materials, or damage to equipment (including 3D printers), arising from or relating to the Application. The Developer's total aggregate liability is limited as set out in section 10 of the Terms of Use. Nothing here limits liability that cannot be limited under applicable law, including your statutory consumer rights.

9. Product claims

The Developer, not Apple or Google, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of it, including but not limited to: (a) product-liability claims; (b) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer-protection, privacy, or similar legislation. This EULA does not limit the Developer's liability beyond what applicable law permits.

10. Intellectual-property claims

In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual-property rights, the Developer — not Apple or Google — will be solely responsible for the investigation, defence, settlement, and discharge of any such claim, to the extent required by this EULA.

11. Legal compliance

You represent and warrant that you are not located in a country subject to a relevant government embargo, or that has been designated as a "terrorist-supporting" country, and that you are not listed on any government list of prohibited or restricted parties.

12. Third-party terms and beneficiaries

You must comply with any applicable third-party terms when using the Application (for example, your wireless data-service agreement). The Application includes third-party components (see Licenses) used under their own terms. Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary. The same applies to Google with respect to applications obtained through Google Play, to the extent Google's terms so provide.

13. Termination

This EULA is effective until terminated. Your rights under it end automatically, without notice, if you fail to comply with any of its terms. On termination you must stop all use of the Application and delete all copies. Uninstalling the Application ends this EULA.

14. Governing law

This EULA is governed by the laws of India, subject to any mandatory consumer- protection law of your country of residence. This choice of law does not apply to any separate Apple or Google terms, which specify their own governing law.
